Terms and Conditions

These Terms and Conditions ("Terms") govern the use of the Piclolo mobile application and related services ("Service") provided by Parklolo UG (haftungsbeschränkt) ("we", "us", "our", "Parklolo").

By creating an account or using the Service, you ("User", "you", "your") agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of the Service

Piclolo is a mobile application for Android and iOS that allows users to:

• Create shared photo and video albums ("events")
• Invite others to contribute via QR codes or username search
• Upload, view, download, and manage photos and videos
• Use face matching (selfie filter) to find photos containing a specific person
• Automatically sync photos via a floating widget (Android)
• Share content from the device gallery directly to the app

3. Account Registration

To use the Service, you must create an account by providing a username, email address, and password. You must:

• Provide accurate and complete information
• Keep your login credentials confidential
• Notify us immediately if you suspect unauthorized use of your account

You are responsible for all activity under your account.

4. Families & Content Safety

Piclolo is designed for users of all ages. We apply the same high privacy standards to every user:

• No advertisements are displayed — Piclolo contains no ads
• No personal data is shared with third parties for marketing purposes
• We collect only the minimum data necessary to provide the Service
• Album owners are responsible for ensuring shared content is appropriate

We comply with the US Children's Online Privacy Protection Act (COPPA), the EU GDPR, and the Google Play Families Policy.

5. Pricing

The Service is currently provided free of charge. We reserve the right to introduce paid features or plans in the future. Any pricing changes will be communicated in advance, and you will not be charged without your explicit consent.

6. User Content

6.1 Ownership

You retain all rights to the photos, videos, and other content you upload ("User Content"). By uploading content to Piclolo, you grant us a limited, non-exclusive license to store, process, display, and transmit your content solely for the purpose of providing the Service.

6.2 Shared Albums

Content uploaded to a shared album is visible to all members of that album. You are responsible for ensuring you have the right to share any content you upload. Album owners may delete content from their albums.

6.3 Prohibited Content

You may not upload content that:

• Violates any applicable law or regulation
• Infringes intellectual property rights of others
• Contains child sexual abuse material (CSAM)
• Is defamatory, threatening, harassing, or promotes violence
• Contains malware, viruses, or other harmful software
• Is spam or unsolicited advertising

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that repeatedly violate these Terms.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with, disrupt, or overload the Service
• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use automated tools (bots, scrapers) to access the Service without permission
• Impersonate another person or entity

8. Face Matching (Selfie Filter)

The selfie filter uses face recognition technology to match your face against photos in a shared album. By using this feature, you consent to the processing of your biometric data for this purpose. The selfie image is used temporarily for matching and is not permanently stored. You can disable the filter at any time.

9. Availability and Maintenance

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will try to provide advance notice of scheduled maintenance where possible.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any loss or damage arising from your use of the Service, including loss of data, photos, or videos
• Our total liability is limited to the amount you have paid us in the 12 months preceding the claim (if any)
• We are not liable for the content uploaded by other users

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

11. Termination

You may delete your account at any time. Upon deletion, your account data will be removed. Content you uploaded to shared albums owned by others may remain in those albums.

We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on the severity of the violation.

12. Intellectual Property

The Piclolo app, its design, code, branding, and logo are the intellectual property of Parklolo UG. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

13. Changes to These Terms

We may update these Terms from time to time. We will indicate the date of the last update at the top. Material changes may be communicated via the app or email. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The courts of Hamburg, Germany have exclusive jurisdiction over any disputes arising from or in connection with these Terms, to the extent permitted by law.
